Assumption of Risk, Release of Claims, and Indemnification Agreement

READ CAREFULLY — THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS

This is a legally binding Release of Liability, Waiver of Legal Rights, and Assumption of Risk (collectively, the "RELEASE") made by the undersigned in favor of High Mountain Hatchets LLC and all "High Mountain Affiliates" as defined below.

DEFINITIONS:

"High Mountain Affiliates" means High Mountain Hatchets LLC ("High Mountain"), including its owners, officers, managers, employees, agents, contractors, lessors, equipment suppliers, insurers, and any person or entity affiliated with its business operations.

"Ax Throwing" means participation in any activity or event involving the use, handling, or presence of axes or hatchets, including but not limited to:

• Throwing axes at targets
• Entering or observing in axe throwing areas
• Use of any equipment, gear, or facility
• Participation in events, instruction, demonstrations, or games
• ANY presence on High Mountain premises related to axe throwing

1. ASSUMPTION OF RISK

I acknowledge and understand that Ax Throwing is inherently dangerous and involves significant risk of injury or death, including but not limited to:

• Being struck by thrown or bounced axes or hatchets
• Slipping, falling, or collision with people or objects
• Use of damaged, misused, or malfunctioning equipment
• Over-exertion, fatigue, stress, or physical trauma
• Emotional or mental distress
• Injury caused by my own negligence, the negligence of others, or equipment failure

These risks may result in serious injury, permanent disability, paralysis, death, or property damage, and may not always be foreseeable. I willingly and voluntarily accept full responsibility for these risks on behalf of myself and any minor child accompanying or under my supervision, including children as young as 6 years old.

2. RESPONSIBILITY FOR MINORS

I certify that any minor child accompanying me, or for whom I am signing this RELEASE, is at least 6 years of age, is physically capable of participating, and that I am the parent or legal guardian authorized to sign on their behalf. I assume full legal responsibility for the supervision, safety, conduct, and medical care of said minor while on High Mountain property or participating in any activity. I understand that High Mountain does not provide supervision for minors, and that allowing a child to participate is entirely at my own risk.

3. RELEASE OF LIABILITY

To the fullest extent permitted by Utah law, I HEREBY RELEASE, WAIVE, AND DISCHARGE High Mountain Affiliates from any and all liability, claims, demands, causes of action, or lawsuits for:

• Personal injury or death
• Property damage or loss
• Medical expenses
• Emotional distress
• Any other damages or losses

…arising from or related to participation in Ax Throwing or presence on High Mountain property, whether caused by the negligence of High Mountain Affiliates or otherwise.

4. AGREEMENT NOT TO SUE

I AGREE NEVER TO SUE OR ASSERT ANY CLAIM against High Mountain Affiliates for any injury, damage, or loss covered by this RELEASE. If I bring a claim in violation of this RELEASE, I agree to be responsible for all legal fees and costs incurred by High Mountain Affiliates in defending such claims.

5. INDEMNIFICATION

I agree to indemnify and hold harmless High Mountain Affiliates from any claims, lawsuits, demands, or liabilities brought by:

• Myself
• My estate, heirs, or personal representatives
• Any minor for whom I am responsible
• Any third party arising from my actions or those of said minor

This includes indemnification for attorneys’ fees, court costs, damages, or judgments.

6. RULES, TERMINATION, AND MEDICAL CARE

I agree to follow all posted and verbal rules, policies, and safety instructions from staff. I understand that High Mountain may terminate my (or a minor’s) participation at any time, for any reason, with no refund. I acknowledge that no medical care is guaranteed to be provided and release High Mountain Affiliates from any responsibility for providing or failing to provide medical treatment.

7. GOVERNING LAW AND ENFORCEABILITY

This RELEASE shall be governed by the laws of the State of Utah. Any dispute shall be resolved in the courts of Wasatch County, Utah. If any portion of this RELEASE is found unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGEMENT OF UNDERSTANDING

I HAVE READ THIS RELEASE CAREFULLY and understand that I am waiving legal rights, including the right to sue or recover damages. I am signing this RELEASE freely and voluntarily, without inducement or coercion, and with full understanding of its consequences.
